老百姓一看就懂的:Zimmerman案的前前后后

事情经过很简单,某雨夜,社区治保队员ZIMMERMAN在自己居住的封闭小区义务巡逻,发现一个陌生黑人少年可能吸了 毒,在该小区东张西望乱窜。他上前 去问,并打了911电话报警,911让他不要继续跟踪,但他还是跟踪了一段,之后跟丢了。他向自己的汽车走过去。但在他到达汽车之前,黑人攻击了他,把他 头部按在水泥地上撞,打得他鼻青脸肿,后脑流血。他右手拔枪,单手贴近自己身体射击,一枪击毙了黑人。

此事不要说警察,常人就推断出ZIMMERMAN不会无故枪击黑人的。他如果存心开枪,就大概不会事前打911报警;如果他拔枪在手,黑人也肯定不敢殴打 他了。所以应该是黑人觉得他没枪才去攻击他的,正当防卫是成立的。所谓ZIMMERMAN跟踪黑人,并不妨碍他行使正当防卫。先动手的一方不能行使正当防 卫,但先动口就无所谓,先跟踪只要不违法就更无所谓了。警察局调查完毕,觉得此事不值得起诉,就让ZIMMERMAN十万美元取保回家。他在家平静地呆了 两个月,期间黑人也没有抗议。

但是,奥巴马手下是有一批人专门发掘种族仇视话题的,觉得此事是个富矿,奇货可居。所以,黑人被立即挑动上街闹事,他们控制的自由派媒体业也以此为借口, 大造舆论。奥巴马甚至公开声称:要是他有一个儿子,一定长得象Trayvon Martin (If I Had A Son, He'd Look Like Trayvon) 。

既然总统都认干儿子了,美国的自由派媒体当即高潮了。其中CBS就高潮过头了,居然篡改剪辑了ZIMMERMAN的911电话报警录音,造成 ZIMMERMAN是种族主义分子的假象,掀起铺天盖地的媒体和黑人政治团体攻击。CBS手段太拙劣了(如果有谁比CNN更拙劣,那就是CBS),被零成 本抓了现行。于是CBS被迫公开道歉并开除了至少3个记者。但Zimmerman律师不依不饶,称道歉太迟了,依然决定起诉CBS,罪名诽谤及故意心理伤 害 defamation and intentional infliction of emotional distress。由于铁证如山,CBS如不和解,官司必输无疑。

当时奥巴马施加的政治压力是非常强大的。当地的警察局长被要求配合。但警察局长说这案子太弱,手中证据不足以支持逮捕,而没有可信理由(probable cause),逮捕是非法的。于是原局长被炒掉了,新局长上任就逮捕了ZIMMERMAN。

随即佛州检察官起诉,依然找不到证据。检方一方面逼着一批黑人做伪证,另外一方面扣留了全部对ZIMMERMAN有利的证据--这都是严重违法行为。扣留 的证据中包括TRAYVON MARTIN的手机里存的数千条短信及手机里的无数照片,其中涉及团伙犯罪、非法枪支买卖及毒品交易。检察院的IT主管看不下去,出庭作证检方非法扣留证 据(在ZIMMERMAN案子递交到陪审团的当天,IT主管也被开除了)。

庭审中,法官迫于政治压力,完全偏袒检方。但庭审对检方依然完全是灾难性的。检方几十个证人破“腚”百出--要么可信度破产,要么完全无关痛痒。而被告证 人、专家却招招见血、逻辑严密、无懈可击。检方完败,拿不出证据情况下,居然要求陪审团去发挥自己的“普通人的感觉common sense”,去判定ZIMMERMAN有罪。这就等同于说,陪审团有权力根据自己的感觉与想象定罪。

在此情况下,法官在政治压力之下,使出了非常卑劣的一招,即允许检方在二级谋杀基础上增加过失杀人罪名。二级谋杀可判终身监禁,过失杀人可判30年监禁。 但在庭审基本结束的情况下,允许检方增加罪名是非常有争议的。依法,自陪审团组成并宣誓之日,就算一重危境了(Jeopardy attaches when the jury is empaneled and sworn),如果允许随意增加罪名,即使不算DOUBLE JEOPARDY(双重危境),也有违背程序正义(DUE PROCESS)的。

检方甚至还异想天开地试图加入三级谋杀罪名(即虐待儿童致死罪)。但吸了毒的TRAYVON MARTIN 比ZIMMERMAN个子高十几公分,还壮实不少;ZIMMERMAN被打得鼻青脸肿,后脑流血,但TRAYVON MARTIN只有一处枪伤,虐待儿童罪实在太匪夷所思了。法官怕落笑柄,不敢答应检方这个要求。

不过为了掩护检方,法官把对陪审团的指令中(jury instruction ),对过失杀人写得非常绕口模煳,希冀能够把陪审团绕进去,助检方蒙混过关。所以陪审团读得一头雾水,不明白怎么回事,只好找法官、双方律师澄清。澄清之后,即判ZIMMERMAN无罪释放。

为什么过失杀人行不通呢?原因很简单,无论是二级谋杀还是过失杀人,检方都要证明ZIMMERMAN不是在正当防卫。哪怕检方证明了接近95%的可能性, 只要陪审团认为存在大于5%的疑虑ZIMMERMAN是在正当防卫,就必须判他无罪。这就是BEYOND REASONABLE DOUBT举证标准。所以被告律师O'MARA在结束辩论时对陪审团说,如果你们有疑虑,请让ZIMMERMAN成为这些疑虑的唯一受益者。这句话是非常 有技巧的。

此案中,被告律师团队的出色工作,早已证明了ZIMMERMAN超过50%的可能性是在正当防卫,超过了被告的举证责任(preponderance of evidence)。从法律上讲,由于检方在否定正当防卫一节证据不足,就既不能证明二级谋杀,也不能证明过失杀人。法官允许检方修改罪名,徒见有意构 陷,是不足以成事的。另外,佛州采用6人制陪审团,这样的陪审团必须意见一致才能定罪。只要一人咬死检方证据不足,就不足以定罪。如果陪审团迟迟不能定 罪,就叫悬而未决的陪审团(HUNG JURY),一般要重审。但此案对ZIMMERMAN证据方面太有利了,不存在HUNG JURY的情况,顺利达到了意见一致。

此案成为美国政府干预司法独立的经典案件。尤其是司法部居然直接组织反ZIMMERMAN游行,成了千古笑柄。操持种族仇恨议题的奥巴马政府目前可谓一地鸡毛。

今天黑人在抗议游行,但传说中的暴乱乃至黑人豹党并未出现。原因很简单,美国各地警察以及支持ZIMMERMAN的白人早已子弹上膛、严阵以待了。只要黑 人出面打砸抢烧杀,警察和所谓“合法持枪公民”们就会横扫了他们。美国黑人,和国内的维族、回族一样,都是永远欺软怕硬的。不过,黑人是敢打 ZIMMERMAN黑枪的--怯懦者永远只敢在背后下手的。

可能还会有4个后续案子:

(1)受害者家庭对ZIMMERMAN的民事诉讼(正当防卫也是适用于民事案件的,ZIMMERMAN既然已证明正当防卫,所以必赢无疑)。

(2)原警察局长告非法解雇案。

(3)原IT主管告非法解雇案。

(4)ZIMMERMAN告CBS诽谤及故意心理伤害案。

估计佛州政府在非法解雇案中,要赔个几百万美元。CBS估计会和解,但代价也不会小。

当然了,询问是不会很粗鲁地问:你在干什么,而是问:需要帮忙吗?

Zimmerman 即使上前询问,也不属于挑事。说句话还不行吗?

关键在于TM 对Zimmerman 攻击。

底下说GZ没有follow 911警察的order,而去follow TM,造成冲突的,有三个错误。
首先,GZ已经下车follow很久了,call了911很久911才说别去。
其次,当时的对话是这样的,是一个婉转的建议,不是order "

Zimmerman: Yeah
Dispatcher: Ok, we don't need you to do that."
最重要的,美国911的接线员不是警察,法律上没有任何权威,911接线员的建议在法律上和普通平民说的没有区别

好文!为黑人抱屈的人基本上是先入为主,无视庭审上的许多证据,不了解相关法律。

但凡能中立的了解了事实真相都会理解Zimmerman的处理方式。

911 要Zimmerman不要跟踪也是为了他的安全。如果他没有枪的话,有可能他已经被黑人打死了

如果不瘦的白胖的女儿住在这个小区,看她是希望有Zimmerman这样的治安员,还是希望有TM这样的访客。

司法的黑暗,政治的腐败,权力的斗争在任何时代,任何国家都有出现。希望您不管是反中,反共,爱国还是只是一介看官,理智的看待问题,理性的辩论问题,不要动辄给人扣上无虚有的阶级帽子,并附以人身攻击。这里不应是泼妇骂街的场所。
PS:中国在30年前才刚刚完成改革开放,还有很长的路要走。

一直觉得17岁小孩死的冤,Z又有一脸凶相,但看了比这篇文章详细的多的维基资料后,认可无罪判决,因为实在有不少的第三方目击证言Z被T袭击,除非Z真的很善于演戏,应该可能性不大。

这案子按照新加坡法律搞得不好还真的2级谋杀,新加坡叫做culpable homicide not amounting to murder. 新加坡的案例,对方徒手袭击,被告持械反击致死的private defence基本上都不成立。当然,美国和英国法系的普通法已经很不一样了,纯属学术探讨。

M去小区完全合法,是M违反警察命令跟踪。问题出在后面的打斗。说谋杀无足够的证据。但所谓的正当防卫在何种程度是"正当"呢?要是M听了警察的话这悲剧也就不会有了。

我也记得是CBS。当然这么说NBC也不冤到什么地方去。的确是难得的好文。论述清楚,条理分明。值得推荐。楼下的"白胖",如果愿意以身试法,我也只能祝你同样下场。不过相信不会引起什么轰动。即便有所报道也就是类似"一青年闲逛动物园,误落虎穴, 被虎吞食"的哀其不幸。打官司,没门儿。

不瘦的白胖... 你说的那种被“持枪歹徒”跟踪的情况,正常人是不会与歹徒发生冲突的,而是率先报警。

这件事情,如果,双方都报警,然后等警察来解决判定一方是否是小偷,那么还会出人命嘛?

看来,最权威的还是得看判决书,其他的文章或多或少都会有误导嫌疑。

无罪判决意料之中。民权人士的努力我欣赏可是他们找错了典型。
最让我失望的是总统。他有权发表个人感想但是要看情况。他那番感言明显干预司法。这不是一个总统应该做的。
希望其他黑人小孩能吸取教训。那这个人算没白死。
自由派媒体我一向支持。民权派我也多支持。可这次他们太过了。企图操纵法律。过线了。

他只是社区守望的志愿者,美国没有治保队这样的组织。当时他因私事出门,也不是在巡逻。黑人少年探望在此小区居住的老爸女友,出门到便利店买东西返回,并非乱窜。

既不能证明这是真的,也不能证明这是假的,陪审团没有采信。

你从何推断“黑人攻击了他”?Zimmerman 持枪等在车里,只因他是黑人,便怀疑他是盗贼,持枪跟踪,叫骂,。。。互殴,至黑人少年被枪杀。

请不要用“吸毒”做幌子,大麻在许多州都是合法的,与吸烟没有什么两样。

什么逻辑?难道 1)是黑人,2)东张西望, 3)吸过大麻, 就该被杀???

OAKLAND -- Police have declared unlawful assembly and were trying to disperse a crowd near Broadway and 14th Street after violence broke out Sunday night in the aftermath of the George Zimmerman acquittal in the shooting death of Trayvon Martin.

A largely peaceful crowed of protesters marched through downtown Oakland on Sunday afternoon, but a small crowd began breaking windows and spray painting graffiti Sunday night along Broadway.

In the late-afternoon march, which started at Frank Ogawa Plaza in downtown Oakland, hundreds of protesters traversed some four-to-five miles and circled back to 14th Street and Broadway where they sat down about 7 p.m., blocking the intersection.

Marchers had been on the
Sunday protest blocks intersection on Market St at 3rd in San Francisco (Karl Mondon)
move for more than two hours, with police monitoring the crowd.

As of 8 p.m., no arrests had been made. But about 10 p.m., a smaller group of protesters began vandalizing businesses along Broadway.

During the afternoon demonstration, there were chants and shouts. "Rest in peace Trayvon Martin; Rest in peace Alan Blueford; Rest in peace Oscar Grant. End the violence," shouted Sellassi Blackwell, 30, of San Francisco, as a crowd before him cheered.

"We are all Trayvon," said Reiko Redmonde, who organized Bay Area protests. "This is not just a question for black youth but for all peoples' humanity, a question of what kind of society and what kind of world we want to live in."

Downtown property owners cleaned up storefronts damaged in a chaotic Saturday night protest as the demonstrations were held Sunday afternoon in Oakland and San Francisco.

Protests had been planned Sunday in East Oakland at 73rd Avenue and International Boulevard, and also at 14th Street and Broadway, and Powell and Market streets in San Francisco. They were part of protests nationwide, with rallies Sunday in Florida, Philadelphia, New York, Chicago, Fresno, Cleveland, and Los Angeles, where a demonstration turned violent.

There, people walked onto Interstate 10 by the Crenshaw Avenue exit and clashed with police. At a nearby street corner a crowd threw rocks and batteries at officers, who fired beanbag rounds. There were no arrests.

The Bay Area demonstrations came after a march that began Saturday, hours after a jury acquitted Zimmerman in a Florida courtroom. At 12:30 a.m.

Sunday, Oakland protesters knocked trash cans into the street and sometimes set the contents alight, creating small fires amid cheers from onlookers.

One man was being beaten by multiple attackers in a Broadway doorway near Frank Ogawa Plaza until other protesters surrounded the skirmish and yelled at the combatants to stop. The man was helped to his feet and did not appear to be seriously injured.

Around 12:45 a.m., demonstrators remained in the area around 19th and Telegraph but numbers had significantly diminished. Some shouted that police were trying to "kettle" them, or corral them into a limited area.

No one was arrested.

On Sunday morning, property owners were boarding up storefronts and cleaning graffiti, but broken glass remained on sidewalks along Telegraph Avenue and Broadway, the two thoroughfares that bore the brunt of the vandalism.

Among the businesses damaged were Sears, the Oakland Tribune, and Flora, a restaurant in the 1900 block of Telegraph Avenue that was nevertheless busy during the lunch hour Sunday.

In a statement, Oakland Mayor Jean Quan said, "a small group of people gathered in downtown Oakland last night. Sadly, some of them dishonored the memory of Trayvon by engaging in violent activities that hurt our growing economy and endangered people.

"This is unacceptable as well. We will not tolerate violence in our city. We must come together to heal and move forward," Quan said. "In the days and weeks ahead our community will continue working to learn from this tragedy and to prevent this from ever happening again."

Nobody thinks the death of Trayvon was a great thing. But, Zimmerman, after a great stretching of evidence, by the prosecution, was found not guilty of 2nd degree murder and manslaughter by a jury of reasonable people.

Why not support Justice in America rather than support a bunch of idiots who will raise hell over anything. They have no right to be vandals.That includes the comments made by Obama throughout this whole process.

    I see these events happening in Oakland and I feel really bad for these businesses. Then I think how stupid those people are to have broken the glass and looted the businesses, perhaps not knowing that they are scaring off many other job-making potentials from ever going into that community. At some point, businesses might well decide that Oakland is NOT worth saving...

Can we stop calling these "demonstrations"? They are riots. The term "demonstration" should be reserved to describe non-violent protest. Once you start vandalizing everything in sight, burning cars and spray-painting graffiti on innocent people's businesses and homes, it is no longer respectable protest. It's a riot.

Signs sponsored by a socialist organization states "The People Say Guilty". Maybe that is the way socialists want their justice to be, but it doesn't work that way here in America to ensure someone's guilt or innocence is judge fairly & legally and not by a mob. The mentality of "The People Say Guilty" has been used all too often to steal prisoners away from law enforcement people and publicly lynch the person to death. It happened in downtown San Jose many years ago. Are public lynching what people want in this country? A public lynching determined by a hot headed group of individuals who claim to represent everyone? The problem with that system is that the one who wants it may be very find themselves the recipient of mob justice when people in power don't agree with their opinions.
