Herod as a representative of the Roman Empire had the authority to impose capital punishment while the Jewish religious authorities had no such Roman backing, or they would certainly have done it themselves. I'm sure Herod did not view Jesus as any kind of threat in the way that the Sanhedrin did and actually seemed to have had some degree of respect for him (according to Luke), at least initially. In the end it required the coercion of Pilate by the Jewish religious leaders to finally achieve Jesus' execution.
